Brazilian man sued over rare gene mutation. Sequence patented by Bayer AG. Defense claims man born before patent issued, judge says prior art not applicable. Bayer states that man used proprietary sequences to improve his genes. Defense claims that the man was born with this mutation. Current state of technology would not be able to distinguish between the two scenarios with 100% certainty. The verdict might be up to the jury.
